1. Acceptance of Terms

These Website Terms of Use, as amended from time to time in the Company’s sole and absolute discretion (these “Terms”), govern your access to websites operated by or on behalf of duPont REGISTRY Group LLC (together with its affiliated companies, “The Naples Automotive Experience, LLC”, the “Company,” “we,” “us,” “our”).

These Terms affect your legal rights, so please read them carefully. Section 15 contains a mandatory arbitration provision requiring arbitration on an individual basis and limiting remedies available to you in certain disputes.

By accessing or using our website (the “Site”) and related services, software, and data (collectively, the “Services”), you agree to be bound by these Terms and all incorporated references.

  • You must be at least 18 years old to use the Services.
  • By accepting these Terms, you confirm you have the legal authority to do so, including on behalf of another person or entity if applicable.
  • If you do not agree, you may not use the Services.

We may revise these Terms at any time. Changes will be effective upon posting or other reasonable notice. Continued use of the Services constitutes acceptance of the revised Terms.

To list, sell, or buy on the Site, you must:

  • Register an account using your real name, address, phone number, and email.
  • Authorize the Company and service providers to charge your credit card for amounts due (fees in U.S. Dollars unless otherwise stated).


2. Role of duPont REGISTRY

2.1 Venue for Buyers and 3rd Party Sellers

The Company may provide a platform for third-party sellers/lessors (“3rd Parties”) and third-party buyers/lessees (“3rd Party Lessees/Buyers”) to conduct transactions (“3rd Party Transactions”).

  • Except as described in Sections 2.2 and 3, the Company is not involved in 3rd Party Transactions and has no liability for them.
  • The Company is not the agent of any 3rd Party or 3rd Party Lessee/Buyer.
  • The Company has no control over the quality, safety, legality, or accuracy of listings.
  • The Company disclaims responsibility for payment, shipment, or performance obligations of parties in 3rd Party Transactions.

You should use caution in 3rd Party Transactions and consider using an escrow agent.

2.2 The Company as Buyer or Seller

When the Company itself engages in a lease, sale, or purchase (“Company Transactions”), the terms in Section 3 apply.


3. Vehicle Lease, Sales, Purchases, and Consignment

3.1 Leasing, Buying, or Selling

To lease, buy, sell, or consign a vehicle through the Services, you must agree to additional terms provided at the time of engagement.

3.2 Sales & Use Taxes

  • Responsibility for determining and remitting applicable taxes (e.g., sales, use, luxury) in 3rd Party Transactions lies solely with the 3rd Party and/or 3rd Party Lessee/Buyer.
  • The Company is not obligated to collect, remit, or report such taxes for 3rd Party Transactions.


4. User Registration

To access certain features, you may need to register:

  • Provide accurate, current, and complete information.
  • Maintain and update your information as needed.
  • Be responsible for actions of anyone authorized to use your account.
  • Notify the Company of any suspected security breach.

You consent to receive electronic communications (including promotional emails/texts, with opt-out options).


5. Right to Access and Use the Services

You are granted a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial use only.

Prohibited actions include (but are not limited to):

  • Selling/reselling the Services or Content.
  • Modifying, reproducing, or distributing Content.
  • Using bots, data mining, or unauthorized downloads.
  • Violating privacy, intellectual property, or Applicable Law.

The Company reserves the right to suspend, restrict, or terminate your access for violations or at its discretion.


6. Trademarks

The Company’s logos, marks, and branding (“Marks”) may not be copied, imitated, or used without prior written consent. Unauthorized use is prohibited.


7. Legal Requirements; Privacy Policy

Your use of Services is also governed by our Privacy Policy.


8. User Content

You are solely responsible for content you upload, post, or transmit (“User Content”). Prohibited activities include:

  1. Registering under a false name or using unauthorized payment methods.
  2. Impersonation or identity misuse.
  3. Posting infringing, illegal, fraudulent, defamatory, or harmful content.
  4. Harassment, threats, abusive behavior, or objectionable content.
  5. Uploading malware, viruses, or malicious code.
  6. Price manipulation, collusion, or unfair trade practices.
  7. Unauthorized advertising, spamming, or solicitation.
  8. Collecting personal data of others (outside of legitimate transactions).

The Company reserves the right to remove, screen, or edit User Content at its discretion.


9. Rights in User Content

By submitting User Content, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, distribute, and display such content.


10. Feedback

Any suggestions, ideas, or materials you submit (“Feedback”) become the sole property of the Company without compensation.


11. Third-Party Sites

Links to third-party websites are provided as a convenience. The Company is not responsible for third-party sites, products, or services.


12. Indemnification

You agree to indemnify and defend the Company against claims, losses, or damages arising from your:

  • Use of Services
  • User Content
  • Feedback
  • Violations of these Terms or rights of others


13. Disclaimers

Services are provided “AS IS” and “AS AVAILABLE.” The Company disclaims all warranties (express or implied), including merchantability, fitness, accuracy, and non-infringement.


14. Limitation of Liability

  • The Company’s liability is limited to U.S. $100.
  • No liability for indirect, incidental, or consequential damages.


15. Arbitration

All disputes must be resolved by binding arbitration (Miami-Dade County, Florida) under the American Arbitration Association’s consumer rules.


16. Class Action Waiver

You may bring claims only in your individual capacity — no class or representative actions.


17. Termination

The Company may terminate your access to Services at any time, without notice, for any reason.


18. Governing Law

These Terms are governed by the laws of the State of Florida, U.S.A.

  • Frequency: Recurring messages (notifications/promotions).
  • Fees: Carrier rates may apply.
  • Opt-In: By providing your number, you consent to receive SMS.
  • Opt-Out: Reply “STOP” or email web@dupontregistry.com.
  • Privacy: Governed by our Privacy Policy.


22. Miscellaneous

  • If any provision is unenforceable, the rest remain valid.
  • These Terms are the entire agreement between you and the Company.
  • No waiver unless in writing.
  • These Terms are intended only for the benefit of the parties.
